These Subscription Terms govern the paid subscription services offered through EmberChic—an AI fashion matching tool designed exclusively for professional women. By purchasing, activating, or using the Subscription Services, you agree to these Terms, as well as EmberChic’s Privacy Policy and Terms of Service. A non-negotiable commitment of our Subscription Services is that we do not collect, store, process, or share any facial information from Subscribers, and this privacy practice remains unchanged regardless of your subscription status or usage of premium features.
EmberChic offers periodic Subscription Services to unlock premium features that enhance your styling experience, while maintaining our core privacy promise: no facial information or personal data is collected at any point. Premium benefits include (but are not limited to):
Subscription plans are available in tiered cycles, as displayed in the App’s subscription page—typically monthly and annual options. Pricing is listed in your local currency, inclusive of all applicable taxes. We reserve the right to adjust pricing or update premium features, but will provide clear, prominent notice to Subscribers at least 7 days before any changes take effect. No changes will reduce the core value of your active subscription cycle.
All Subscription Services are purchased exclusively through the App Store’s official in-app purchase system. By selecting a subscription plan, you authorize Apple Inc. to charge your registered payment method (e.g., credit card, Apple ID balance, or other payment methods linked to your Apple account) for the full subscription fee. Billing is processed immediately upon initial purchase to activate the Subscription Services for the first cycle.
EmberChic does not collect, store, or process any of your payment information—all billing, payment security, and transaction records are managed solely by Apple, in compliance with their industry-leading security standards. We have no access to your payment details, and there is no link between your payment information and any content or usage of the App (including locally stored outfits or text data).
All Subscriptions auto-renew at the end of each billing cycle (monthly/annual) unless you disable auto-renewal at least 24 hours before the current cycle expires. You can manage your subscription settings—including disabling auto-renewal, viewing billing history, and canceling your subscription—directly through your Apple ID settings. Clear, step-by-step instructions for managing subscriptions are provided in the App’s subscription page for your convenience.
No refunds or prorated credits are offered for partial billing cycles, unused premium features, or early cancellation. Upon cancellation, your Subscription Services will remain active until the end of the current paid cycle. After expiration, you will revert to the free version of EmberChic, which includes limited features. Canceling your subscription does not affect your access to outfits saved locally on your device, as we do not collect or store this content on our servers.
As a Subscriber, you have the right to access all premium features for the duration of your active subscription. You agree to use the Subscription Services solely for personal, non-commercial purposes. Sharing your subscription access with others (e.g., family, friends), creating multiple accounts to exploit premium features, or using the App for commercial activities (e.g., selling generated outfits, using the tool for professional styling services) is prohibited.
You remain solely responsible for the content you use within the App—including photos uploaded for text extraction and text descriptions for outfit generation. You confirm that you have the legal right to use all such content, and acknowledge that no facial information is collected from any photos you upload. We are not liable for any content you generate, share, or store, nor for any claims of infringement, harm, or loss arising from your use of the Subscription Services.
You agree not to tamper with, reverse-engineer, or modify the App’s premium features, or bypass any restrictions related to subscription access. Violating these terms may result in immediate suspension of your Subscription Services without refund.
Your subscription status does not alter EmberChic’s core privacy practices: we still do not collect any facial information, personal data, device identifiers, usage analytics, or any other identifiable content from Subscribers. All premium features—including high-resolution generation, priority processing, and exclusive effects—operate through local processing on your device. No data related to your premium usage, generated outfits, or text input is uploaded to our servers, shared with third parties, or retained beyond your local device storage.
Your subscription status (active/expired) is stored locally on your device using secure storage methods, ensuring complete privacy. The only information related to your subscription is managed by Apple (e.g., subscription status, billing history), and we do not access, store, or process this information.
We may add new premium features, adjust existing ones, or optimize the Subscription Services to enhance user experience—provided such changes do not materially reduce the core value of your active subscription. Significant updates will be notified to Subscribers via in-app prompts.
In the unlikely event we discontinue the Subscription Services entirely, we will refund any pre-paid subscription fees for unused billing cycles. We will provide at least 14 days’ notice to Subscribers before discontinuing services, allowing you to manage your subscription and save any locally stored content.
The Subscription Services are provided “as is” for personal use. We do not guarantee uninterrupted access to premium features, or that generated outfits will meet your exact expectations. We are not liable for any disruptions caused by technical issues, app maintenance, third-party tool outages, or Apple’s billing system errors.
Our liability for the Subscription Services is limited to the total amount you paid for the current billing cycle. We shall not be liable for indirect, incidental, consequential, or special damages—including (but not limited to) loss of use, lost content, or financial losses—even if we have been advised of the possibility of such damages.
We may update these Subscription Terms to reflect changes in our services, pricing, or applicable requirements (e.g., App Store guidelines). When updates are made, we will notify you via a prominent in-app pop-up. Your continued use of the Subscription Services after the update constitutes your acceptance of the revised Terms. We will never modify these Terms to allow the collection of facial information or personal data, regardless of subscription status.
